In compliance with the duty of information contained in Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, the following data is reflected: the company that owns the web domain is FUNDACIÓ PRIVADA JOSEP FINESTRES (hereinafter "the Foundation"), of the Universitat de Barcelona (UB) group with CIF G-59418202 and domiciled for this purpose in Feixa Llarga, S/N - 08907, L' Hospitalet de Llobregat, Barcelona.

Your personal data will be included in a file which is the responsibility of the Foundation in order to manage the health and administrative services of our centres, which may be used for teaching or research purposes, to remind you of your appointments or reviews and to provide you with the information and/or services you request, as well as to inform you about those services which we believe may be of interest to you.

The Foundation may communicate your personal data to the other companies that make up the Universitat de Barcelona group if this is relevant to the purpose requested or authorised. The FUNDACIÓ JOSEP FINESTRES and the other entities that make up the UB group undertake not to communicate your personal data to third parties outside the UB group. The exception to this is in cases where, in accordance with the purpose for which the data was obtained, it becomes necessary to pass it on to persons acting on behalf of or in relation to the business of UB Group.

USERS

The access and/or use of this portal of the Foundation attributes the condition of USER, who accepts, from such access and/or use, the General Conditions of Use reflected here. The mentioned Conditions will be applied independently of the General Conditions of Contracting that in their case are of obligatory fulfillment.

PORTAL USE

This portal provides access to a multitude of information, services, programs or data (hereinafter, "the contents") on the Internet belonging to the FUNDACIÓ JOSEP FINESTRES, creator of the website, or to its licensors, to which the USER may have access. The USER assumes responsibility for the use of the portal. This responsibility extends to the registration that may be necessary to access certain services or content.

In such registration the USER will be responsible for providing truthful and legal information. As a consequence of this registration, the USER may be provided with a password for which he will be responsible, committing himself to make a diligent and confidential use of it. The USER agrees to make appropriate use of the content and services (such as chat services, discussion forums or news groups) that the FUNDACIÓ JOSEP FINESTRES creator of the web site offers through its portal and, by way of example but not limitation, not to use them for:

(i) - to engage in activities that are illicit, illegal or contrary to good faith and public order

(ii) - to disseminate content or propaganda of a racist, xenophobic, pornographic or illegal nature, or in support of terrorism or in violation of human rights

(iii) - cause damage to the physical and logical systems of the Foundation that created the website, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that may cause the aforementioned damage;

(iv) - attempt to access and, where appropriate, use the e-mail accounts of other users and modify or manipulate their messages. The Foundation that created the website reserves the right to withdraw all those comments and contributions that violate the respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that attempt against youth or children, the order or public security or that, in its opinion, are not suitable for publication. In any case, the Foundation that created the website will not be responsible for the opinions expressed by the users through the forums, chats, or other participation tools.

DATA PROTECTION

The FUNDACIÓ JOSEP FINESTRES creator of the website complies with the guidelines of Regulation (EU) 2016/679 of the Parliament and Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and other regulations in force at any given time, and ensures that the user's personal data is used and processed correctly. To this end, together with each form for the collection of personal data, in the services that the user may request from the Foundation, the user will be informed of the existence and acceptance of the particular conditions of the processing of his or her data in each case, informing him or her of the responsibility for the file created, the address of the person responsible, the possibility of exercising his or her rights of access, rectification, cancellation and opposition, limitation of processing, data portability, revocation of consent and not to be subject to automated individualized decisions, as well as the purpose of the processing and communications of data to third parties where appropriate.

Likewise, the Foundation informs you that it complies with Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce and will request your consent to the processing of your e-mail for commercial purposes at any time.

PRIVACY POLICIES

This privacy policy applies to all the health centres that make up the Josep Finestres Foundation (hereinafter, "the Foundation") with regard to the processing of their patients' personal data (and/or their representatives or legal guardians, web users and the general public (hereinafter, jointly and indistinctly, the "Stakeholders”). To see the centres that make up the Foundation, please go to the section "Managed Centres" at the bottom of this page.

The Foundation ensures that it has data protection policies that preserve the security of the personal data of its patients and any other interested parties. Therefore, in accordance with the provisions of Regulation (EU) 2016/679 of the Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "GDPR"), the Foundation informs the Stakeholders of the following:

DATA SOURCE

For the purposes of the provisions of Regulation (EU) 2016/679 on the processing of personal data, we inform you that the person responsible for processing your data is the Foundation's centre that attends to you and/or provides you with health care, and in the event that you have subscribed to our newsletter or requested information about our services and/or products offered through the websites, the person responsible is the one who sends it to you.

The data that we collect and incorporate into our data processing system may come from the interested party himself, the patient, during the visit to our health centres or during the admission and navigation on our website, or if applicable, from his legal or voluntary representative and health personnel, as well as on the basis of his subscription to our newsletter.

DATA CATEGORIES

The categories of personal data that we process in connection with your relationship with us are as follows:

  • Identification and contact data of patients or their representatives, including name and surname, nationality, address, contact details (telephone, e-mail), marital status, signature, image, health card, social security number or mutual insurance company;
  • Personal characteristics;
  • Transactional data related to payments, receipts, transfers, debits
  • Health-related data, incorporated in the patient's clinical history.

The purposes for which the person in charge of the Foundation processes personal data are, by way of illustration but not limitation, the following:

  • To provide health care requested or required by the patient and to manage the administrative services necessary for effective health care, including:
  • Manage the control of access, stay and permanence in our facilities.
  • Provision of remote access services (on-line) to medical results (i.e., analyses, etc.) through platforms enabled by the Foundation.
  • Conduct internal surveys.
  • Manage, validate and control the payment of the assistance services provided;
  • Manage visits, appointments and reviews.
  • To process orders, requests or any type of petition that is made by the user through any of the forms of contact that are made available to the user on the Foundation's website.
  • Carry out opinion surveys and subsequent statistical studies in order to improve the service.
  • Sending commercial communications of our products and services, newsletters, as well as special offers, even by electronic means, provided that you have previously authorized it.
  • To comply with the legal or statutory obligations to which the Foundation is subject.
  • Security and access control to the facilities by means of video surveillance, through which real-time images are collected of people entering the centre.
  • Scientific research purposes, always with the previous express consent of the interested party.

Therefore, the data collected will be processed for the purposes, regardless of the means of communication used to contact the corresponding Foundation centre (in person at the health centre, mobile applications, the centre's website, telephone or e-mail).

Teaching and training purposes for university students in the degree of dentistry and postgraduate studies at the University of Barcelona.

Manage complaints, requests and suggestions submitted by the patient.

We inform you that, although you are not obliged to answer all the questions asked when collecting your data, we will ask for your collaboration so that the information is as accurate as possible, true and complete in order to improve diagnosis and treatment (patients) or to provide you with the information you need (web users or general public). The data requested are necessary, so that if you do not provide them it will not be possible to formalize the desired relationship. In the case of acting on behalf of minors or incapacitated persons, you will be asked to accredit this condition, taking into account the property of the represented party, and you will be required to provide documentation to this effect. Your signed consent will be requested to use this data for other purposes.

LEGITIMATION

The legal basis for legitimising such processing of your data is:

  • The express and free consent of the Interested Party;
  • The legitimate interest of the data controller in providing adequate health care, in responding to requests from the data subject, in fulfilling contractual and legal obligations and, where appropriate, in managing video surveillance systems;
  • The execution of contracts to which the Stakeholder is a party;
  • The fulfilment of legal obligations;
  • The necessary treatment for scientific research.

In this way, the Foundation informs you that it will proceed to process the data in a lawful, loyal, transparent, adequate, relevant, limited, exact and updated manner.

CONFIDENTIALITY

All the information you provide us with will be treated confidentially, especially health data, and all the doctors and staff are obliged to keep its contents duly secret and confidential in accordance with Law 14/1986, the General Health Act, Law 41/2002 on Patient Autonomy, Regulation (EU) 2016/679 on Personal Data Protection and other related provisions.

All information provided will be treated confidentially and we inform you that we take all necessary technical and organisational measures to prevent access by unauthorised third parties.

RETENTION PERIOD

The data provided by the Interested Party will only be kept for the time strictly necessary for the purpose for which they were collected.

Personal data derived from the provision of health care: these will be kept for a minimum of 5 years from the date of registration of each health care process, unless otherwise developed by regulation or sector.
Processing of data collected for sending newsletters to which the interested party has subscribed: these data will be kept until you decide to revoke your consent, unsubscribe and/or exercise, where appropriate, your rights of opposition and/or deletion.

Personal data processed in order to manage, but not limited to, requests for information from the Foundation, complaints, exercise of access rights, requests and suggestions sent by the Interested: these will be kept for the time legally established, or in their place, for the time necessary to process the request or for the formulation, exercise or defence of claims.

Personal data processed in order to comply with legal obligations: they will be kept for the period of time established in the applicable legislation.

Personal data processed in order to comply with contractual obligations: they will be kept for the duration of the contractual relationship, or where appropriate, for the period necessary for the formulation, exercise or defence of claims.

Images captured through video surveillance systems: they shall be kept for a maximum period of 30 days from their capture, except when they have to be kept for the corresponding prescription period, to prove the commission of acts that harm the integrity of persons, goods or facilities.

Personal data processed for scientific research purposes: they will be kept for an unlimited period of time, with the patient's consent or after the data have been made anonymous.

DATA TRANSFERS TO THIRD PARTIES

Patients: In order to guarantee an adequate provision of the health care service, it is necessary that entities of the UB group, its undergraduate and postgraduate students related to dental studies, external collaborators and/or certain service providers such as, but not limited to, health care services, video surveillance services, archive services, storage and destruction of documentation, legal advice services, and IT services (hosting, software providers) process data on behalf of the person responsible as data processors.

Web users and the general public: in order to maintain a relationship with you and to provide you with the information you require, it is necessary for entities in the UB group, undergraduate and postgraduate students in the field of dentistry at the UB, external collaborators and/or certain service providers such as, but not limited to, video surveillance services, legal advice and IT services (hosting, software providers), to process data on behalf of the person responsible as data processors.

No data of the Interested Parties will be communicated to third parties, except with the prior consent of the Interested Party, legitimate interest of the person in charge or by legal obligation, except in the following cases and to the following recipients:

  • insurance companies or mutual companies of which the patient is a beneficiary,
  • public administrations or a third party in the case of liability insurance,
  • hotel entities or tour operators that channel the relationship with the insurance company), as long as the patient makes this known,

In such cases, the Centre may provide information on the services provided to such entities, including the patient's personal data, in order to manage, coordinate and process the payment of the care services provided by the Foundation's centre, otherwise the care services would not be provided because they could not be properly invoiced.

In case the patient is insured by an insurance company located outside the European Economic Area whose legislation does not provide sufficient guarantees equivalent to those imposed in the RGPD, an international transfer of data may be necessary. Such transfers take place with the patient's explicit consent and full information, with the sole purpose of providing the care service to the patient and facilitating the management and verification of the payment of the care services provided.

Likewise, in those cases in which, due to their treatment, it is necessary to use prostheses, implants or any other specific medical or surgical material, your personal data may be communicated to the supplying entities, solely and exclusively, for this purpose

They may also communicate their data to ambulance service providers and any other collaborators required to provide the services, duly informing the interested party, in accordance with the provisions of the RGPD.

Your data may be transferred to the Catalan Health Service in the cases provided for by law; to consulates and to the State Security forces (at the prior request of police, judicial or tax authorities);

In case of opposition or disagreement with these circumstances, you must inform the Foundation's centre before receiving health care. The contracts entered into with the aforementioned third parties, by virtue of the provisions of the RGPD, guarantee that the data provided will be treated solely and exclusively for the determined, explicit and legitimate purposes for which they were obtained and that they will not be communicated to entities outside the contractual relationship with these third parties, unless otherwise provided for by law.

ACCESS PERMISSIONS

We inform you that you have the possibility to exercise at any time and free of charge, except in the cases of art. 12.5 of Regulation (EU) 679/2016, the right to access the information that affects you contained in the processing systems of the entity, as well as its rectification, cancellation and opposition, limitation of processing, data portability, revocation of consent and not to be subject to automated individualized decisions. You may exercise these rights by writing to fundacio.josep.finestres@ub.edu, enclosing a copy of your national identity card, passport or other valid document that identifies you in a timely manner. You also have the right to consult the DPO on any matter relating to the processing of your personal data, by writing to: dpo.fjf@ub.edu, as well as to file a complaint with the supervisory authority, which in Spain is the Spanish Data Protection Agency (AEPD) if you consider it appropriate.

INTELLECTUAL AND INDUSTRIAL PROPERTY

The Foundation, either by itself or as an assignee, is the owner of all the intellectual and industrial property rights of its website, as well as of the elements contained therein (including but not limited to images, sound, audio, video, software or text; brands or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by the FUNDACIÓ JOSEP FINESTRES or its licensors. All rights reserved. By virtue of the provisions of articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including making available, of all or part of the contents of this website, for commercial purposes, on any support and by any technical means, without the authorization of the Foundation, is expressly prohibited. The USER undertakes to respect the Intellectual and Industrial Property rights owned by the Foundation. He will be able to visualize the elements of the portal and even print them, copy them and store them in the hard disk of his computer or in any other physical support as long as it is, only and exclusively, for his personal and private use. The USER must abstain from deleting, altering, eluding or manipulating any protection device or security system that was installed in the pages of the Foundation.

DISCLAIMER OF WARRANTIES AND LIABILITY

The Foundation is not responsible, in any case, for the damages of any nature that could cause, as an example: errors or omissions in the contents, lack of availability of the portal or the transmission of viruses or malicious or harmful programs in the contents, despite having adopted all the necessary technological measures to avoid it.

MODIFICATIONS

The Foundation reserves the right to make any changes it considers appropriate to its portal without prior notice, and may change, delete or add both the content and services provided through the portal and the way in which they are presented or located on the portal.

LINKS

In the event that links or hyperlinks to other Internet sites are provided in the name of the domain, the Foundation shall not exercise any control over such sites and content. In no case shall the name of the company that created the website assume any responsibility for the contents of any link belonging to a third party website, nor shall it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, veracity, validity and constitutionality of any material or information contained in any of these hyperlinks or other Internet sites. Likewise, the inclusion of these external links will not imply any type of association, merger or participation with the connected entities.

RIGHT OF EXCLUSION

The Foundation reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, at its own request or that of a third party, to those users who do not comply with these General Conditions of Use.

GENERAL

The Foundation will pursue the breach of these conditions as well as any improper use of its portal exercising all civil and criminal actions that may correspond in law.

MODIFICATION OF THESE CONDITIONS AND DURATION

The Foundation may at any time modify the conditions determined here, being duly published as they appear here. The validity of these conditions will depend on their exposure and will remain in force until they are modified by other duly published conditions.

APPLICABLE LAW AND JURISDICTION

The relationship between the Foundation and the USER shall be governed by the Spanish regulations in force and any dispute shall be submitted to the Courts and Tribunals of the city of Barcelona.
